This article will examine the claim that personal autonomy is impaired by a paradigmatic instance of serious psychopathology – namely, the condition of being delusional – in light of the hierarchical conception of personal autonomy. This conception of personal autonomy aims at yielding value‐neutral judgements about freedom and self‐governance. I will argue that when viewed from the perspective of this specific conception of autonomy, delusions do not necessarily impair an agent's personal autonomy. In order to establish this claim, I will (...) probe the general idea that delusional subjects are beset by a mental disease that is rationally incapacitating, to which the hierarchical theorist might appeal. In this paper I argue that Wittgenstein's aim in the aspect-perception passages is to critically evaluate a specific hypothesis. The target hypothesis in these passages is the Gestalt psychologist Köhler's "isomorphism principle." According to this principle, there are neural correlates of conscious perceptual experience, and these neural correlates determine the content of our perceptual experiences. Wittgenstein's argument against the isomorphism principle comprises two steps. First, he diffuses the substantiveness of the principle by undermining an important assumption that underpins this principle, (...) namely, that there is a unitary concept of seeing. Next, Wittgenstein argues that some forms of aspect-perception involve recognitional capacities, the exercise of which is normatively constrained. The normative nature of aspect-perceiving plays a pivotal role in Wittgenstein's rejection of the isomorphism principle. Aside from the clear exegetical benefits gained from identifying the target hypothesis in the aspect-perception passages as the isomorphism principle, construing the remarks in the way suggested here is also philosophically interesting in its own right: it shows Wittgenstein engaging directly in the mind–body problem, construed as the problem of intentionality. Psychopathy is often used to settle disputes about the nature of moral judgment. The “trolley problem” is a familiar scenario in which psychopathy is used as a test case. Where a convergence in response to the trolley problem is registered between psychopathic subjects and non-psychopathic subjects, it is assumed that this convergence indicates that the capacity for making moral judgments is unimpaired in psychopathy. This, in turn, is taken to have implications for the dispute between motivation internalists and motivation externalists, (...) for instance. In what follows, we want to do two things: firstly, we set out to question the assumption that convergence is informative of the capacity for moral judgment in psychopathy. Next, we consider a distinct feature of psychopathy which we think provides strong grounds for holding that the capacity for moral judgment is seriously impaired in psychopathic subjects. The feature in question is the psychopathic subject’s inability to make sincere apologies. Our central claim will be this: convergence in response to trolley problems does not tell us very much about the psychopathic subject’s capacity to make moral judgments, but his inability to make sincere apologies does provide us with strong grounds for holding that this capacity is seriously impaired in psychopathy. There is a Long-Standing concern that psychiatrists have the task of fitting a square peg into a round hole: the empirical generalizations upon which diagnoses are made have seemed too many to overlook something essential about the individual person who is the subject of the diagnosis. This concern prompted a World Psychiatric Association (WPA) workgroup to suggest that a personalized component should be added to patients’ diagnostic assessment (IDGA Workgroup 2003). My aim in this paper is to critically evaluate John Campbell's (2002) characterization of the sense of demonstrative terms and his account of why an object's location matters in our understanding of perceptually-based demonstrative terms. Campbell thinks that the senses of a demonstrative term are the different ways of consciously attending to an object. I will evaluate Campbell's account of sense by exploring and comparing two scenarios in which the actual location of a seen object is different from its perceived (...) location. I do this in order to motivate the following point: Campbell's characterization of the sense of a demonstrative term turns sense into a psychologistic notion. As a consequence of this, it is difficult to see how sense could underwrite reference. In short, I shall be arguing that Campbell's account of the ways of perceiving an object is simply inadequate as an account of the Fregean notion of sense, according to which the senses of a demonstrative term are the different ways of thinking about an object. This chapter gives a survey of the field of philosophy where the philosophical foundations of modern logic were discussed and where such themes of logic were discussed that were on the borderline between logic and other branches of the philosophical enterprise, such as metaphysics and epistemology. The contributions made by Gottlob Frege and Charles Peirce are included since their work in logic is closely related to and also strongly motivated by their philosophical views and interests. In addition, the chapter pays (...) attention to a few philosophers to whom logic amounted to traditional Aristotelian logic and to those who commented on the nature of logic from a philosophical perspective without making any significant contribution to the development of formal logic. As artificial intelligence technologies become increasingly prominent in our daily lives, media coverage of the ethical considerations of these technologies has followed suit. Since previous research has shown that media coverage can drive public discourse about novel technologies, studying how the ethical issues of AI are portrayed in the media may lead to greater insight into the potential ramifications of this public discourse, particularly with regard to development and regulation of AI. This paper expands upon previous research by systematically analyzing (...) and categorizing the media portrayal of the ethical issues of AI to better understand how media coverage of these issues may shape public debate about AI. Our results suggest that the media has a fairly realistic and practical focus in its coverage of the ethics of AI, but that the coverage is still shallow. A multifaceted approach to handling the social, ethical and policy issues of AI technology is needed, including increasing the accessibility of correct information to the public in the form of fact sheets and ethical value statements on trusted webpages, collaboration and inclusion of ethics and AI experts in both research and public debate, and consistent government policies or regulatory frameworks for AI technology. This article discusses findings from a mixed method literature review that investigated cancer patients’ perceptions of what constitutes a good nurse. To find pertinent articles, we conducted a systematic key word search of five journal databases (1998—2008). The application of carefully constructed inclusion criteria and critical appraisal identified 12 relevant articles. According to the patients, good nurses were shown to be characterized by specific, but inter-related, attitudes, skills and knowledge; they engage in person-to-person relationships, respect the uniqueness of patients, and (...) provide support. Professional and trained skills as well as broad and specific nursing and non-nursing knowledge are important. The analysis revealed that these characteristics nurtured patient well-being, which manifests as optimism, trust, hope, support, confirmation, safety and comfort. Cancer patients’ perceptions of what constitutes a good nurse represent an important source of knowledge that will enable the development of more comprehensive and practice-based views on good nursing care for such patients. These perceptions help us to understand how nurses effectively make a difference in cancer patient care. (shrink)

Is there a Confucian vision of China's marketing law and practice? To what extent have China's norms for marketing, mainly intellectual property and advertising law, been challenged by the new government policy toward a harmonious society? In the post World Trade Organization accession period, the theoretical framework of the (...) "socialist harmonious society" has turned law into a disciplinary principle given over to society's moral construction. If law is seen as an instrument for legitimizing power, it remains implicitly bound primarily to ensure the regime's durability. Although more and more ordinary citizens and foreign companies are seizing hold of normative tools being put at their disposal, this does not necessarily mean that Chinese law is implemented in a uniform and timely manner throughout China's territory. China still suffers from a lack of coherence and political will in the drafting of a legal reform that aims mainly at preserving the current fragile political balance. Contradictory forces are indeed at work in this legal construction that is torn between liberal leanings and socialist authoritarianism. Without a deep change in perspective, one can expect only relatively slow progress in protecting the intellectual property rights of the many Chinese and foreign goods and services that can be found on the Chinese market. Today, the US pursues the global capture of data (understood as a significant engine of growth) by way of bi- and plurilateral trade agreements. However, the project of securing the global free flow of data has been pursued ever since the dawn of digital telecommunication in the 1960s and the US has made significant legal efforts to institutionalise it. These efforts have two phases: In the first 1970s and 80s “freedom of information” phase, the legal justification (and contestation) of the (...) global free flow of data hinged on imagining data as information, and its exchange as a practice of liberty. The second phase began in the late 1990s and continues today. In this phase, the free flow of data is aligned with a free-trade agenda in the context of first e-commerce and, starting in the 2000s, through attempts at creating a global public domain of personal data for the platform economy. The global free flow of data is an intrinsic aspect of informational capitalism. Assuming a constitutive, but not commanding role for law in informational capitalism, we conclude that the US attempt at ensuring free flow for its informational corporations is neither an entirely contingent nor a necessary outcome. AI systems play an increasingly important role in shaping and regulating the lives of millions of human beings across the world. Calls for greater _transparency_ from such systems have been widespread. However, there is considerable ambiguity concerning what “transparency” actually means, and therefore, what greater transparency might entail. While, according to some debates, transparency requires _seeing through_ the artefact or device, widespread calls for transparency imply _seeing into_ different aspects of AI systems. These two notions are in apparent tension with (...) each other, and they are present in two lively but largely disconnected debates. In this paper, we aim to further analyse what these calls for transparency entail, and in so doing, clarify the sorts of transparency that we should want from AI systems. We do so by offering a taxonomy that classifies different notions of transparency. After a careful exploration of the different varieties of transparency, we show how this taxonomy can help us to navigate various domains of human–technology interactions, and more usefully discuss the relationship between technological transparency and human agency. We conclude by arguing that all of these different notions of transparency should be taken into account when designing more ethically adequate AI systems. (shrink)

According to the Extended knowledge dilemma, first formulated by Clark (Synthese 192:3757–3775, 2015) and subsequently reformulated by Carter et al. (in: Carter, Clark, Kallestrup, Palermos, Pritchard (eds) Extended epistemology, Oxford Univer- sity Press, Oxford, pp 331–351, 2018a), an agent’s interaction with a device can either give rise to knowledge or extended cognition, but not both at the same time. The dilemma rests on two substantive commitments: first, that knowledge by a subject requires that the subject be aware to some extent (...) of some features of that knowledge’s sources and, second, that cognitive processes can only be extended if the subject is mostly unaware of the external object. The overwhelming response to the dilemma by proponents of extended knowledge has been to reconcile the demands of knowl- edge with the requirement that genuine extended cognition must lack any conscious encountering of the external artifact that features in the putative extended cognitive process. My approach, thus far unexplored, will be the opposite: I show how extended cognition can be made compatible with a wide range of agential attitudes, including an active form of epistemic hygiene. Consequently, I open the door for a new way of vindicating the possibility of extended knowledge, and call into question some assumptions that lie at the core of extended cognition theory. (shrink)

Extended cognition brings with it a particular phenomenology. It has been argued that when an artifact is integrated into an agent’s cognitive system, it becomes transparent in use to the cognizing subject. In this paper, I challenge some of the assumptions underlying how the transparency of artifacts is described in extended cognition theory. To this end, I offer two arguments. First, I make room for some forms of conscious thought and attention within extended cognitive routines, and I question the close (...) association drawn between attention and effort. Second, I vindicate the importance of paying careful attention to individual differences and the diverse ways in which bodies and technologies can be experienced. I end by offering some hints toward an alternative, and more accurate, account of the phenomenology of extended cognition. (shrink)

In this chapter, I propose a new framework for extended epistemology, based on a second-wave approach to extended cognition. The framework is inclusive, in that it takes into account the complex interplay between the diverse embodiments of extended knowers and the salient properties of technological artifacts, as well as the environment in which they are embedded. Thus it both emphasizes and exploits the complementary roles played by these different elements. Dung’s (1995) argumentation framework takes as input two abstract entities: a set of arguments and a binary relation encoding attacks between these arguments. It returns acceptable sets of arguments, called extensions, w.r.t. a given semantics. While the abstract nature of this setting is seen as a great advantage, it induces a big gap with the application that it is used to. This raises some questions about the compatibility of the setting with a logical formalism (i.e., whether it is possible to (...) instantiate it properly from a logical knowledge base), and about the significance of the various semantics in the application context. In this paper we tackle the above questions. We first propose to fill in the previous gap by extending Dung’s (1995) framework. The idea is to consider all the ingredients involved in an argumentation process. We start with the notion of an abstract monotonic logic which consists of a language (defining the formulas) and a consequence operator. We show how to build, in a systematic way, arguments from a knowledge base formalised in such a logic. We then recall some basic postulates that any instantiation should satisfy. We study how to choose an attack relation so that the instantiation satisfies the postulates. We show that symmetric attack relations are generally not suitable. However, we identify at least one ‘appropriate’ attack relation. Next, we investigate under stable, semi-stable, preferred, grounded and ideal semantics the outputs of logic-based instantiations that satisfy the postulates. For each semantics, we delimit the number of extensions an argumentation system may have, characterise the extensions in terms of subsets of the knowledge base, and finally characterise the set of conclusions that are drawn from the knowledge base. The study reveals that stable, semi-stable and preferred semantics either lead to counter-intuitive results or provide no added value w.r.t. naive semantics. Besides, naive semantics either leads to arbitrary results or generalises the coherence-based approach initially developed by Rescher and Manor (1970). Ideal and grounded semantics either coincide and generalise the free consequence relation developed by Benferhat, Dubois, and Prade (1997), or return arbitrary results. Consequently, Dung’s (1995) framework seems problematic when applied over deductive logical formalisms. (shrink)

A concretização do direito à saúde deve ser viabilizada pelo Estado, com foco na efetivação das políticas públicas para garantia da implantação e funcionamento dos serviços demandados pelos respectivos grupos populacionais. Destarte, essa escrita objetivou analisar como o direito à saúde é contemplado em comunidades quilombolas de uma região geográfica baiana. Metodologicamente enquadra-se como de abordagem qualitativa, com informações obtidas por meio de entrevistas estruturadas (sobre a infraestrutura e/ou serviços públicos de saúde) desenvolvidas com as representações das Associações de Moradores (...) de 14 quilombos da região geográfica de Guanambi/Bahia durante o ano de 2016. Os achados indicam que uma comunidade possuía estrutura física específica para atendimentos básicos em saúde, no entanto, estava desativada. Três comunidades não tinham cobertura do Programa de Agentes Comunitários de Saúde (PACS). Entre as 11 que indicaram cobertura do Programa, em sete as(os) profissionais não residiam no território do quilombo. Diante da ampla ausência de infraestrutura e recorrente inadequação na prestação de serviços do PACS, evidencia-se a permanente negligência ao direito à saúde nesta população quilombola. (shrink)

This paper investigates when two abstract logic-based argumentation systems are equivalent. It defines various equivalence criteria, investigates the links between them, and identifies cases where two systems are equivalent with respect to each of the proposed criteria. In particular, it shows that under some reasonable conditions on the logic underlying an argumentation system, the latter has an equivalent finite subsystem, called core. This core constitutes a threshold under which arguments of the system have not yet attained their final status and (...) consequently adding a new argument may result in status change. Sterilisation is the most desired method of contraception worldwide. In 1996, the Brazilian Congress approved a family planning law that legitimised female and male sterilisation, but forbade sterilisation during childbirth. As a result of this law, procedures currently occur in a clandestine nature upon payment. Despite the law, sterilisations continue to be performed during caesarean sections. The permanence of the method is an important consideration; therefore, information about other methods must be made available. Tubal sterilisation must not be the only (...) choice. We argue that review of this restriction will not contribute to the increase in caesarean sections but will allow for greater sterilisation choice for men and women. (shrink)

El presente artículo aborda la pregunta por la filosofía, las ideas y la verdad en el pensamiento spinoziano, así como el camino para acceder a ellas. Para esto, trazamos un recorrido histórico que comprende una serie de cartas y comentarios que incluyen a Burgh, Steno y Leibniz. Esto nos permitirá, por un lado, mostrar la relevancia histórico-filosófica del debate y, por otro, sostener nuestra hipótesis, según la cual Spinoza consideraría su filosofía como verdadera porque parte de una concepción sobre la (...) naturaleza misma de las ideas que no otorga un estatuto de realidad al error en cuanto tal, dado que en la inmanencia spinoziana no hay ideas completamente inadecuadas o falsas. The impact of stress and other psychological variables on Inflammatory Bowel Disease prognosis, treatment response, and functional level is well-established; however, typical IBD treatment focuses on the physiological pathology of the disease and neglects complementary stress-reducing interventions. Recent pilot studies report the benefits of mindfulness-based interventions in people living with IBD, but are limited by small sample sizes. Recruitment challenges to in-person studies may be in part due to the difficulty IBD patients often have adhering to fixed schedules and travel (...) as a result of IBD symptoms such as pain, fatigue, and incontinence. The current study aimed to address this barrier by offering participants access to online mindfulness training, allowing individuals to engage with intervention materials to fit their own schedule. Online mindfulness programs have gained popularity in recent years, as they increase access and flexibility and decrease cost to the user; however, the dropout rate tends to be high. The current study compared the rate of adherence and efficacy of mindfulness training as a function of level of support: self-guided versus supported. Analysis revealed no significant difference in the benefits received between participants in the two groups; however, a significant difference group was found in terms of rate of completion, with 44.1% of the supportive group completing the protocol compared to 11.7% of the self-guided. Common challenges to meditation were measured, but did not significantly predict adherence to the intervention, and experience of these challenges did not significantly change over the duration of the study. Implications of the current research, future directions for the use of MBI for IBD patients, and a discussion of methodological considerations are provided. (shrink)

During a dialogue, agents exchange information with each other and need thus to deal with incoming information. For that purpose, they should be able to reason effectively about trustworthiness of information sources. This paper proposes an argument-based system that allows an agent to reason about its own beliefs and information received from other sources. An agent's beliefs are of two kinds: beliefs about the environment and beliefs about trusting sources . Six basic forms of trust are discussed in the paper (...) including the most common one on sincerity. Starting with a base which contains such information, the system builds two types of arguments: arguments in favour of trusting a given source of information and arguments in favour of believing statements which may be received from other agents. Mind wandering refers to a state when attention shifts from the task at hand or current situation toward thoughts, feelings, and imaginations. This state is often accompanied by a decline in mood, and patients suffering from major depression exhibit more perseverative MW. Hence, although the directionality of the relationship between mood and MW is still under investigation, it may be useful to explore possible avenues to reduce MW. In an earlier pilot study, we investigated MW during auditory beat stimulation in (...) healthy subjects using thought-probes during a sustained attention to response task. We found evidence for reduced MW during monaural 5 Hz beats compared to silence, sine tones, and binaural 5 Hz beats. Moreover, the data tentatively suggested that this reduction was particularly pronounced in subjects with high levels of MW during silence. In the current study, we therefore asked whether MW can be reduced by monaural theta beats in subjects with high trait-levels of MW, as indicated by an online MW questionnaire. Preselected subjects performed a SART task with thought-probes assessing the propensity to mind wander, meta-awareness, and the temporal orientation of MW. Stimulation conditions comprised monaural theta beats, as well as silence, and sine tones as control conditions. Our main hypothesis stating that the propensity to mind wander during monaural theta beats is reduced compared to both control conditions was only partly confirmed. Indeed, MW was significantly diminished during exposure to the theta beats compared to sine tones. However, reduced MW during theta beats versus silence was only observed in a subgroup using stricter inclusion criteria. Considering possible reasons for this outcome, our data suggest that the preselection procedure was suboptimal and that beat effects are modulated by the individual responses to auditory stimulation in general. Since Xi Jinping has taken office in 2012, China’s political repression has only but intensified so that the regime is definitively turning away from the 1990s legal reforms and the many expectations that followed in terms of rule of law and other rights fostering. In replacing these recent developments in a larger perspective including that of a “socialist harmonious society”, which had already shaded a particular light on Chinese reforms, this article proposes to envisage contemporary Chinese legal culture in an (...) evolutionary and theoretical framework. In doing so, it stresses the tensions between a language of rights now fully integrated by the Chinese citizens and the politics of law used, in a last legal ditch struggle, by the Chinese Communist Party as a tool for social stability in disciplining the people by all means including by the threat of its very legal creations. It then concludes in reflecting upon the legal culture emerging out of this great divide between the people and the State. (shrink)

The process of agricultural unification will dominate the German scene for the next few years. At this stage, however, analysis and forecasts are hampered by the considerable problem concerning the viability of East German agriculture in a market economy and by the absence of reliable data in the German Democratic Republic (GDR). This can only be understood in terms of the agricultural situation in the GDR before unification, which is discussed in the first section. The political and economic incentives for (...) German unification are described in the next section of this paper, focusing especially on the integration of the GDR into CAP. The third section considers some critical structural, legal, social, and economic constraints in the process of integrating the two agricultural systems. Finally, the implications for German agriculture as well as the challenges for the CAP will be addressed. Data were collected from interviews with key agricultural policy makers, farm organizations, commodity groups, consumer groups, and agricultural experts, as well as interviewing East German farmers. Additional data were compiled from government statistics, EC publications, and press reports. The conclusions reached in this research show the urgent need for the German government to reconsider the objectives and rationale for structural policies in agriculture, and point out that the new Germany, itself full of paradoxes and uncertainty, stands at the center of European agricultural disorder. It is difficult to understand the meaning of ‘dignity’ in human rights, bioethics and nursing literature because the word is used so vaguely. Unless dignity’s meaning is spelt out it can disappear beneath more tangible priorities. In this article we define dignity and show how this can help health workers to maintain the dignity of people in their care.
